Terms and Conditions
MyPolitics is owned and operated by Flygon LC (“MyPolitics,” “we,” “us,” or “our”). These Terms are an agreement between you and Flygon LC. These Terms and Conditions (“Terms”) govern your relationship with and use of the MyPolitics website and related services (collectively, the “Services”), so please read them carefully.
All references to “you” or “your” mean the person who accesses, uses, and/or participates in the Services in any manner, and each of your heirs, assigns, and successors. By using the Services, you agree to be bound by these Terms. If you are using the Services on behalf of an organization, you are agreeing to these Terms on behalf of that entity and representing that you have the authority to bind that entity. If you do not agree to these Terms, you may not access or use the Services.
We also have a Privacy Policy that applies to your use of the Services and is incorporated into these Terms.
1. General Conduct
You agree to abide by these Terms and all applicable state, national, and foreign laws and regulations in your use of the Services. You agree not to: (a) use the Services to send unsolicited or unauthorized advertising, spam, or other duplicative or unsolicited messages; (b) harvest or collect information about users for the purpose of unsolicited communications; (c) post or transmit unlawful, harassing, defamatory, threatening, harmful, invasive of another’s privacy, vulgar, obscene, or otherwise objectionable material; (d) post or transmit any material that may infringe the intellectual property or other rights of third parties; (e) post or transmit any material that contains software viruses or other harmful code; (f) interfere with or disrupt servers or networks connected with the Services; (g) attempt to gain unauthorized access to the Services or other accounts or systems; (h) harass or interfere with another user’s use of the Services; (i) use automated means to “scrape,” “crawl,” or “spider” the Services unless explicitly authorized in writing; (j) engage in “framing,” “mirroring,” or otherwise simulating the appearance or function of our website; (k) attempt to override any security component; (l) use the Services for any commercial distribution or exploitation without prior written permission; (m) alter, edit, or remove any content, code, or materials on the Services; (n) create multiple accounts or misrepresent your identity; or (o) attempt to do any of the foregoing. We reserve the right to investigate and prosecute violations to the fullest extent of the law and to cooperate with law enforcement.
2. Your License to Use the Services
Subject to these Terms, you are granted a personal, nontransferable, non-exclusive, revocable license to use the Services solely for their intended use. You may not, without our prior written consent: (a) modify or copy the materials on the Services; (b) use the materials for any commercial purpose or public display; (c) attempt to decompile, reverse engineer, or create derivative works from any software on the Services; (d) remove any copyright or proprietary notations; or (e) transfer or “mirror” the materials on any other server. We may, at our sole discretion, limit, deny, or create different levels of use for different users, or discontinue functionality at any time. This license shall automatically terminate if you violate any of these restrictions.
3. Proprietary Rights and Feedback
MyPolitics and/or its licensors own all right, title, and interest in and to the Services and materials thereon, including all content, data, design, and organization, and all intellectual property and proprietary rights therein. The trademarks, logos, and service marks displayed on the Services are our property or the property of third parties. Nothing on the Services should be construed as granting any license to use any mark without written permission.
By sending us any suggestions, ideas, feedback, or other information (“Feedback”), you represent that you have the right to disclose it and that it does not violate the rights of others. You grant us an irrevocable, non-exclusive, royalty-free, perpetual, worldwide license to use, modify, publish, distribute, and sublicense the Feedback, and you waive any moral rights in such Feedback.
4. Eligibility
You must be at least 13 years of age to use the Services. If you are located in the European Economic Area, United Kingdom, or Switzerland (collectively, “European”), you must be at least 16 years of age to use the Services. By using the Services, you represent and warrant that you meet the applicable minimum age for your location. Our Services are not targeted to anyone below the applicable minimum age. We may refuse to offer the Services to any person or entity for any reason. The Services are offered for your personal use only.
5. Your Content
If you have the opportunity to post, upload, or submit materials to the Services (“Submitted Materials”), we do not wish to receive any confidential or proprietary information. Any Submitted Materials may be used by us in a manner consistent with these Terms and the Privacy Policy. By submitting materials, you: (a) represent that they are original to you and comply with these Terms; and (b) grant us a royalty-free, worldwide, perpetual, irrevocable, non-exclusive license to use, reproduce, modify, publish, and distribute such materials. You agree not to upload content that is fraudulent, unlawful, threatening, abusive, defamatory, obscene, infringing, or that contains viruses or advertising. You are solely responsible for your Submitted Materials.
6. Copyright Policy
We will respond to notices of alleged copyright infringement that comply with applicable law (including the DMCA). If you believe materials on the Services infringe your copyright, you may submit a written DMCA notice that includes: (1) identification of the copyrighted work; (2) identification of the infringing material; (3) your contact information; (4) a statement of good faith belief that use is not authorized; (5) a statement that the notice is accurate; (6) a statement, under penalty of perjury, that you are authorized to act on behalf of the copyright owner; and (7) your physical or electronic signature. Send DMCA notices to our designated agent (contact information available at the end of these Terms). If you believe material you posted was removed by mistake, you may submit a counter notification as permitted by the DMCA. We may disable and/or terminate the accounts of repeat infringers.
7. Accounts
To use certain features, you may need to register for an account. You are responsible for providing truthful and accurate registration information and maintaining its accuracy. We may suspend or terminate your account at any time in our sole discretion. You are responsible for maintaining the confidentiality of your login information and for all activities under your account. Do not share your credentials or create more than one account.
8. Third-Party Services and Links
The Services may link to other websites or resources. When you access third-party services, you do so at your own risk. We are not responsible or liable for the content, accuracy, legality, or any other aspect of such sites or services. The inclusion of a link does not imply our endorsement. We shall not be liable for any damage or loss caused by or in connection with the use of any third-party content, goods, or services.
9. Communications (SMS / 10DLC)
Where we use SMS or other messaging, we comply with 10-digit long code (10DLC) requirements and applicable carrier and regulatory rules.
10. Candidate Photos and Third-Party Content
Photos of candidates are not hosted on our website; we link to or reference external sources. We have no liability for such content. Whenever possible we use images that are Creative Commons licensed or in the public domain.
11. Term and Termination
Your right to use the Services automatically terminates upon your breach of these Terms. We may terminate the licenses granted hereunder and the availability of the Services for any reason or no reason. Sections that by their nature should survive (including 2, 3, 6, 7, 11-14, and 16-20) shall survive termination.
12. Disclaimer of Warranties
THE SERVICES ARE FOR INFORMATIONAL AND EDUCATIONAL PURPOSES ONLY AND ARE PROVIDED “AS IS,” WITH NO EXPRESS, STATUTORY, OR IMPLIED WARRANTIES. WE DISCLAIM THE WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED OR ERROR-FREE, OR REGARDING THE COMPLETENESS OR ACCURACY OF ANY MATERIALS. WE ASSUME NO RESPONSIBILITY FOR ANY DAMAGES TO YOUR EQUIPMENT OR FOR ANY THIRD PARTY CONDUCT OR CONTENT. NO ADVICE OR INFORMATION OBTAINED FROM US OR THROUGH THE SERVICES WILL CREATE ANY WARRANTY NOT EXPRESSLY MADE HEREIN. SOME JURISDICTIONS DO NOT ALLOW LIMITATIONS ON IMPLIED WARRANTIES; WHERE PROHIBITED, SUCH LIMITATIONS MAY NOT APPLY TO YOU.
Profile images
You are responsible for any profile image you link, including obtaining all necessary rights and permissions. You must not use unlawful, sexually explicit, exploitative, threatening, harassing, hateful, impersonating, privacy-invasive, or infringing images. Linking an image does not make it approved or endorsed by MyPolitics or Flygon LC.
To the extent permitted by law, MyPolitics and Flygon LC disclaim responsibility for user-supplied images. We may remove images and suspend or delete accounts for violations of these rules or our Terms, without prior notice where permitted by law. This does not exclude responsibilities or rights that cannot lawfully be excluded. External image hosts may receive your IP address and browser information when an image loads.
13. Limitation of Liability and Release
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE AND OUR AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AND LICENSORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, PUNITIVE, OR EXEMPLARY DAMAGES, OR FOR ANY THIRD-PARTY CLAIMS, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. IF YOU ARE A CALIFORNIA RESIDENT, YOU WAIVE CALIFORNIA CIVIL CODE § 1542 (AND ANY SIMILAR LAW IN YOUR JURISDICTION) REGARDING UNKNOWN CLAIMS.
IN NO EVENT SHALL OUR TOTAL AGGREGATE LIABILITY TO YOU FOR ALL DAMAGES ARISING FROM THESE TERMS OR YOUR USE OF THE SERVICES EXCEED THE GREATER OF (A) TWENTY-FIVE US DOLLARS ($25), OR (B) THE AMOUNT, IF ANY, PAID BY YOU TO US FOR YOUR USE OF THE SERVICES. SOME JURISDICTIONS PROHIBIT LIMITATIONS OF LIABILITY; THE ABOVE MAY NOT APPLY TO YOU.
14. Indemnification
You agree to indemnify and hold harmless MyPolitics and its affiliates, officers, directors, employees, and licensors from any claim, damage, loss, liability, or expense (including attorneys’ fees) arising from or relating to your use of the Services in violation of these Terms or your infringement of the rights of others.
15. Modification of Terms or the Services
Except for the arbitration and dispute resolution provisions, we reserve the right to change, amend, or modify these Terms at any time. You are responsible for reviewing these Terms periodically. Your continued use after changes constitutes acceptance. We may also modify, suspend, or discontinue the Services (or any part) at any time with or without notice. We shall not be liable to you for any such modification, suspension, or discontinuance.
16. Settling Disputes Between You and MyPolitics
Informal resolution. Before initiating a lawsuit or arbitration, you agree to contact us with a written notice that includes your name, email/username, a description of the issue, and how you’d like to resolve it. You must engage in this informal process before starting formal dispute resolution, unless exempted by law.
Agreement to arbitrate. If informal resolution fails, either party may initiate binding arbitration as the sole means to resolve disputes (except as set forth below). This agreement is governed by the Federal Arbitration Act. Arbitration will be administered by a mutually agreed arbitration provider. The arbitrator, and not any court, shall have exclusive authority to resolve disputes. YOU AND MYPOLITICS EACH WAIVE THE RIGHT TO A TRIAL BY JURY TO THE MAXIMUM EXTENT PERMITTED BY LAW.
Class arbitration waiver. ANY ARBITRATION SHALL BE CONDUCTED IN AN INDIVIDUAL CAPACITY ONLY AND NOT AS A CLASS OR REPRESENTATIVE ACTION. THE ARBITRATOR MAY AWARD RELIEF ONLY IN FAVOR OF THE INDIVIDUAL PARTY SEEKING RELIEF.
Exceptions. Either party may bring claims of patent, copyright, trademark, or trade secret infringement in court. Either party may elect small claims court for claims within its jurisdiction. Either party may seek provisional or injunctive relief in court. You may opt out of this arbitration agreement by sending written notice within 30 days of your first use of the Services to the contact below.
17. Class Action Waiver
YOU AGREE THAT ANY DISPUTE NOT SUBJECT TO ARBITRATION MAY ONLY BE PURSUED BY YOU ON AN INDIVIDUAL BASIS, AND YOU MAY NOT BRING A CLAIM AS A PLAINTIFF OR CLASS MEMBER IN A CLASS, COLLECTIVE, OR REPRESENTATIVE ACTION.
18. Jury Trial Waiver
IF A DISPUTE PROCEEDS IN COURT RATHER THAN ARBITRATION, YOU AND MYPOLITICS UNCONDITIONALLY WAIVE ANY RIGHT TO TRIAL BY JURY IN ANY ACTION ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICES.
19. General
Governing law. These Terms shall be governed by the laws of the State of California, without regard to conflict of law principles. Any dispute shall be subject to the exclusive jurisdiction of the state and federal courts of California, except where mandated by applicable law.
Waiver and severability. If any provision is held illegal, invalid, or unenforceable, the remaining provisions shall not be affected. No waiver shall be valid unless in writing.
Entire agreement. These Terms constitute the entire agreement and supersede all prior agreements concerning the subject matter.
Assignment. You may not assign these Terms without our prior written consent. We may transfer our rights and obligations at any time.
Statute of limitations. Any claim or cause of action arising out of the Services or these Terms must be filed within one (1) year after such claim arose or be forever barred (where permitted by law).
